I respond to the letter on 4 March 2015, with which you have asked for the opinion of this Pontifical Council concerning two issues on m.p. Mitis Iudex Dominus Iesus (MIDI).
After careful consideration of the two questions, I would like to inform you of the following clarification.
With regard to the question on the Procedural Rules, the answer to the first question is given by m.p. MIDI in the final part, where it specified that the Procedural Rules are joined to the same motu proprio because they are deemed "necessary for the correct and accurate application of the renewed law, to be diligently observed to protect the good of the faithful" and in the same text of the Procedural Rules in the introductory part, where we read that "together with the detailed rules for the application of the marriage process, it seemed opportune ... to offer some details so that the work of the tribunals can respond to the needs of the faithful, who require the verification of the truth on the existence or not of the bond of their failed marriage.”
Regarding the second question on the mémoire introductif d'instance, the answer is given by the disposition of the new can. 1676 §1, which does not determine for notification to the respondent of the mémoire introductif d'instance together with the libellus.
